Terms and Conditions

The following terms and conditions (‘The Terms’) shall be incorporated into every contract for sale and/or delivery of goods (‘the goods’) by Oztilia Ozparts sp. z o.o. sp. kom. (‘The Seller’).

All quotations given, orders accepted and credit extended by The Seller is subject to the following terms.

1. Retention of Title

The Buyer hereby acknowledges that the goods supplied by the Seller shall remain the property of the Seller until the Seller receives full payment from The Buyer.

2. Pricing

Prices quoted by way of a representative of The Seller or Published price lists are subject to change without notice and are not binding by The Seller.

The prices of goods shall be exclusive of all delivery charges and insurance costs which shall be payable by the buyer.

The Seller reserves the right to increase prices to take into account any increase in cost to The Seller or for supplying of Goods.

All clerical errors in prices are subject to correction by The Seller.

3. Acceptance Of Order

(a) The Seller’s acceptance of the Order is subject to these terms and conditions of sale and to any additional terms and conditions that may be contained in the Seller’s price lists or quotations pursuant to which the order was given.

(b) These terms and conditions of sale may only be amended with the written consent of the Seller.

(c) The Terms and conditions of sales referred to in clause 3a shall take precedence over any additional or inconsistent terms and conditions contained in the Buyers order, or in the Buyers request for quotation.

4. Acceptance of Goods

Acceptance of goods delivered by the Buyer shall be deemed to have taken place at the expiration of 3 days from the date of delivery to the buyer.

5. Delivery

The Seller will make all reasonable efforts to have the goods delivered to the Buyer on the date agreed between the parties as the delivery date, but the Supplier shall be under no liability whatsoever should delivery not be made on this date.

The seller reserves the right of supplying any order in full or part. All freight and transit charges are the responsibility of the Buyer.

6. Freight & Insurance

(a) Insurance is not included in the freight charge. Insurance, if required, is the responsibility of the purchaser and must be arranged before dispatching of goods.

(b) Customers wishing to nominate another freight company and or freight method, other than the one used by the Seller, must make arrangements prior to dispatch of goods.

(c) All cost incurred and insurance, if required, are the responsibility of the purchaser.

7. Payment

Standard terms are prepaid, or C.O.D. Payment must be made in full at time of purchase. Direct payments can be deposited into our bank account, paid by credit card or by paypal.

8. Use of Trade Name and Trademarks

Customers shall not use Oztilia Ozparts sp. z o.o. sp. kom. trade name or trademarks, or any portion thereof, within the customer’s name.

Customers shall have no right, interest in, or claim, on any such trade names or trademarks.

9. Catalogues, Price Lists and Technical References

Catalogues, Price Lists and Technical References provided to the Purchaser by the Supplier whether in printed or electronic form shall remain the property of the Supplier at all times and are not to be reproduced by any means without written approval of the Supplier.

The Supplier shall not be held responsible for any errors or omissions in said Catalogues, Price Lists and Technical References.

10. 30 days returns – conditions

If you are not satisfied with your purchase, please follow the instructions below to return the item.

Returns are acceptable within 30 days from the day of purchase (date of invoice).

Special order items (Air freight) are final and cannot be returned.

All returns must be in their original conditions, originally packed (without any signs of opening) and include all original manufacturer’s packaging and/or tags.

Please email us at support@xforce.eu before returning any products.

Important! Please, make sure that you include in the parcel filled Return Form (you can download below) together with a copy of the receipt and send it within 30 days from the day of purchase (date of receipt).

You can download our return form here. Please, fill it out completely and send in the box with your return. Please include your details, part number and explain the reason of the return.

Any returns not approved by us will be refused. You will be responsible for shipping to us and back to you so be sure to contact us prior to taking any action.

When shipping returned items, you are responsible to pack and ship items properly so the items do not get damaged or lost in transit.

We will be glad to refund undamaged and unused items with no restocking fee within 30 days from the date of sale.

11. Shipping Options

UPS Standard – Orders placed and paid on-line till 2:00 pm are being processed the same day

12. Warranty

If you would like to make a warranty claim please simply fill up the warranty claim form online.

Please note all fields must be filled up and pictures needs to be added. Once form is complete please submit it. Warranty claim will be automatically sent to us. Upon receiving your claim, we will send you a claim number and at the same time it will be passed to the manufacturer who will make a decision on it. If claim is approved credit note or replacement part FOC will be provided.
